Merchant Terms and Conditions

1. Introduction

Welcome to Qbuster ("we," "our," or "us"). Qbuster is a contactless dining platform that empowers restaurants to provide a seamless, modern ordering experience. Our service allows customers to scan unique QR codes at their tables to browse menus, place orders, and pay instantly, while enabling kitchen staff to receive and manage these orders in real-time through a dedicated dashboard.

These Terms and Conditions ("Terms") govern your use of the Qbuster platform and services as a merchant. By registering for an account or using our services, you agree to be bound by these Terms.

2. Account Registration and Usage

  • 2.1. Single Profile Policy

    Each company or legal entity is permitted to create and maintain only one profile on the Qbuster platform.

  • 2.2. Account Responsibility

    The merchant ("customer company") bears full responsibility for all user accounts it creates. You agree not to transfer or hand over your account data or credentials to third parties. You are solely responsible for maintaining the confidentiality of your account information.

  • 2.3. Security Breaches

    In the event that your account data or credentials have been compromised, you must notify Qbuster immediately at hello@qbuster.xyz.

  • 2.4. Subscription and Trial Terms

    We may offer a free trial period (e.g., 30 days) which begins automatically upon the placement of your first order. Upon expiration of the trial or any paid subscription term, if a valid payment method is not provided, we reserve the right to suspend or restrict access to the Service. We are not responsible for any data loss that may occur as a result of account suspension due to non-payment.

3. Platform Usage and Restrictions

3.1. Allowed Use

The only permitted use of the Qbuster application is to intake and process orders for the customer's restaurant operations.

3.2. Prohibited Items

It is strictly illegal and prohibited to display, sell, or promote:

  • Alcohol
  • Tobacco products
  • Any other restricted or regulated substances that are not foods and meals
3.3. Content Ownership and License

By uploading images, menu items, descriptions, or other content ("Merchant Content") to the Platform, you retain your ownership rights in that content. However, you grant Qbuster a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute such Content in connection with the provision of our Service. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all Merchant Content.

3.4. Intellectual Property

The Qbuster Platform, including its software, code, design, logos, and trademarks, is the exclusive property of CERTIFIT, SIA. Nothing in these Terms grants you any right to use the Qbuster name, logo, or other intellectual property branding without our prior written consent.

4. Liability and Responsibilities

4.1. Limitation of Liability

To the maximum extent permitted by applicable law, CERTIFIT, SIA limits any potential liability arising from the use of the platform to a maximum amount equivalent to three (3) yearly subscription fees paid by the merchant.

4.2. Allergen Notification

Merchants are solely responsible for notifying customers of any allergens contained in the food and meals they offer. Qbuster is not liable for any allergic reactions or health issues arising from the consumption of food ordered through the platform.

4.3. Payment Processing

Qbuster facilitates payments through third-party payment processors (e.g., Stripe). We are not a bank and do not offer banking services. You are the "merchant of record" for all transactions. You are solely responsible for all refunds, chargebacks, and disputes with your customers. You agree to comply with the Stripe Connected Account Agreement.

4.4. Service Availability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We are not liable for any loss of revenue or business arising from service downtime or technical issues.

5. Indemnification

You agree to defend, indemnify, and hold harmless Qbuster, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal fees, arising out of or in any way connected with: (i) your access to or use of the Service; (ii) your violation of these Terms; (iii) your Merchant Content; or (iv) any dispute between you and any customer (e.g., regarding food quality, delivery, or transactions).

6. Changes to Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
